Daynes, with her wealth of experience within the British legal system, introduced us to the intriguing world of false confessions. Contrary to popular belief, Daynes said, false confessions are not confined to American jurisprudence nor are they exclusive to the intellectually challenged or the naive. It was during our discussions that she recommended delving into the works of Gisli Gudjonsson, an authority in the field of forensic psychology, whose groundbreaking research has reshaped the understanding of this complex phenomenon.
Gudjonsson, an Icelandic scholar, has dedicated his career to unraveling the intricacies of false confessions and suggestibility. His seminal studies have revolutionized the landscape of forensic psychology, illuminating the psychological origins that influence confession evidence. Through meticulous research and unwavering dedication, Gudjonsson has left an indelible mark on criminal justice systems worldwide.
The allure of Gudjonsson’s work led us to explore one of the most harrowing cases of police brutality and injustice—a saga that unfolded within the confines of Iceland’s legal system. The ordeal endured by the suspects was nothing short of Kafkaesque, as they languished in solitary confinement for unfathomable durations.

Erla, one of the accused, endured the torment of solitary confinement for a staggering 242 days. Two others were subjected to over 600 days of isolation, while Tryggvi, suffered through an unimaginable 655 days, the longest solitary confinement period recorded outside the confines of Guantanamo Bay. Sævar, another victim of the system’s cruelty, endured a total of 1,533 days in custody; a haunting testament to the systemic failures that marred this case.
Reflecting on the case, Gudjonsson expressed his shock and dismay at the intensity of the interrogation tactics employed by law enforcement. “I’ve worked on miscarriages of justice in many different countries. I’ve testified in several countries—hundreds of cases I’ve done, big cases. I’d never come across any case where there had been such intense interrogation, so many interrogations and such lengthy solitary confinement. I mean I was absolutely shocked when I saw that,” he remarked in an interview with the BBC.
Until the 1980s, it was widely believed that only individuals with cognitive impairments or mental illness were susceptible to giving false confessions during police interrogations. However, the advent of detailed case analyses, academic research, and DNA exonerations shattered this misconception. False confessions, it was revealed, arise from a complex interplay of psychological factors and environmental influences, transcending the confines of cognitive or mental impairment.

The phenomenon of false confessions extends beyond the mere act of confessing to a crime one did not commit. Coercive interrogation methods have a profound and lasting impact on the memories and perceptions of the individuals subjected to them. Gudjonsson has termed this phenomenon “Memory Distrust Syndrome,” wherein individuals develop a profound distrust of their own memory recollections, rendering them particularly susceptible to external cues and suggestions.
As filmmakers we ask numerous questions such as: “How do coercive interrogation methods manipulate the human psyche?” “What role do law enforcement officials, investigators and legal practitioners play in perpetuating this phenomenon?” Most importantly: “How do we safeguard against the miscarriage of justice in the face of such coercive tactics?” In our quest for answers, we are confronted with the sobering truth that false confessions can happen to anyone, anywhere. Ultimately our aim is to analyse all the collected answers and transcend them into a compelling and thought-provoking documentary series.
